Terms of Use

These terms are the agreement between you and Idlery Services LLC for Elemora: Periodic Table. Please read them — they are short, and they are written to be understood.

What these terms cover

These terms apply to the Elemora: Periodic Table application for iOS, to this website at elemora.idlery.com, and to any subscription you buy for the app. By downloading or using Elemora, you agree to them. If you do not agree, please do not use Elemora.

Our Privacy Policy is part of this agreement and explains what Elemora does with information.

What Elemora is

Elemora is an educational reference and study app about the chemical elements. It presents the periodic table, element data and written explanations, lets you practise with flashcards, quizzes and identification drills, tracks what you have studied, and lets you assemble formulas and look at compound structures.

It is a learning tool. It is not a laboratory instrument, a measurement device, a safety data sheet, a regulatory reference, a dispensing or dosage aid, or a substitute for professional, medical, academic or scientific judgement.

Educational use and the limits of the data

We work to make Elemora's chemistry accurate and to describe it clearly, but we do not warrant that every value, explanation, diagram, structure or classification in the app is complete, current or correct. Published values differ between sources, are revised over time, and are often rounded or simplified for teaching.

Elemora says so where it matters. Its shell diagrams are labelled as a simplified model, with a note that electrons do not travel on fixed circular paths. Its bonding hints are labelled not a verification: they are there to help you think, and they do not certify that a structure you have built is chemically valid, stable, safe or real.

Do not rely on Elemora for anything where being wrong matters. It must not be used as the basis for laboratory work, handling or storing chemicals, safety decisions, medical or veterinary decisions, industrial processes, regulatory compliance, or graded academic work submitted as fact. Check a primary source, your instructor, or the relevant safety documentation.

Nothing in Elemora is an instruction or an encouragement to synthesise, obtain, handle or combine any substance.

Where the chemistry data comes from

Elemora's element data, explanations, structure diagrams and compound catalogue are compiled from published scientific and reference literature and are presented in our own words and our own presentation. Where a value is a commonly published constant, it is what it is; where Elemora explains or summarises, that is our editorial work.

If a future version of Elemora draws information from an external service, that service's own terms will apply to that information, and we will say so in the app and in the Privacy Policy.

If you think something in Elemora is wrong, please tell us at support@idlery.com. We would rather fix it than defend it.

Compounds you build and save

Formulas you assemble, compounds you save and favourites you mark are yours. They are stored on your device; we do not claim ownership of them and we do not receive them.

Because they are stored on your device, keeping them is up to you. Deleting Elemora, resetting your progress, or setting up a new device without restoring a backup that included Elemora will remove them. We cannot recover them for you, because we never had a copy.

Intellectual property

Elemora, the name “Elemora”, the Elemora icon and marks, the app's software, its written explanations, its artwork and diagrams, its compiled catalogue and the design of this website are owned by Idlery Services LLC and are protected by copyright, trademark and other laws. Nothing in these terms transfers any of that to you.

Apple, the Apple logo, iPhone, iPad and App Store are trademarks of Apple Inc. Other names mentioned may be trademarks of their respective owners. Elemora is not affiliated with, endorsed by, or sponsored by Apple Inc.

Your licence to use Elemora

Subject to these terms, Idlery Services LLC grants you a personal, limited, non-exclusive, non-transferable, revocable licence to use Elemora on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service and by Apple's Standard End User Licence Agreement. This licence does not give you ownership of the app, and it ends if you stop complying with these terms.

Subscriptions

Elemora may offer an auto-renewable subscription that unlocks additional features. If you buy one, the following applies.

Restoring a purchase

If you reinstall Elemora or move to another device, use Restore Purchases in Elemora's settings while signed in to the Apple Account that made the purchase. A purchase can only be restored to the account that bought it.

Refunds

Purchases are made through the App Store, so Apple handles refunds under its own policies. Request one at reportaproblem.apple.com. Idlery Services LLC cannot grant or reverse an App Store charge. This does not affect any statutory refund or cancellation right you have where you live.

Apple's role and Apple's EULA

Elemora is distributed through the App Store. Your download and any purchase are also governed by Apple's Apple Media Services Terms and Conditions and by Apple's Standard End User Licence Agreement for Licensed Applications, which is published by Apple on Apple's own website.

These terms do not replace Apple's Standard EULA. They sit alongside it. Where these terms and Apple's Standard EULA cannot both be satisfied, Apple's Standard EULA governs your licence to the application, and these terms continue to apply to everything else.

This agreement is between you and Idlery Services LLC, not with Apple. Apple is not responsible for Elemora or its content, and Apple has no obligation to provide any maintenance or support for it — support comes from us, at support@idlery.com. If Elemora fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation for Elemora. Apple is not responsible for addressing any claim relating to Elemora, including product liability, a failure to conform to a legal requirement, or a claim under consumer protection or similar legislation. Apple is not responsible for investigating, defending, settling or discharging any third-party claim that Elemora infringes intellectual property rights.

Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and on your acceptance Apple has the right to enforce them against you as a third-party beneficiary.

You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.

Changes to Elemora and to these terms

Features can change, be added or be removed between versions, and a feature available today is not guaranteed to be available forever. We may update these terms; when we do, the version number and effective date at the top of this page change. This page at https://elemora.idlery.com/terms is the canonical, current version. Continuing to use Elemora after a change means accepting the updated terms.

No warranty

To the maximum extent permitted by law, Elemora is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory — including any implied warranty of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment or non-infringement. We do not warrant that Elemora will be uninterrupted or error-free, that defects will be corrected, or that its content is accurate or complete.

Limits on responsibility

To the maximum extent permitted by law, Idlery Services LLC is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, lost progress, lost study records, or the cost of substitute products or services, arising out of or relating to Elemora or these terms — whether the claim is in contract, tort, negligence, strict liability or otherwise, and even if we have been advised that such damages are possible.

To the maximum extent permitted by law, our total liability for all claims relating to Elemora is limited to the greater of the amount you paid Idlery Services LLC or Apple for Elemora in the twelve months before the claim arose, or twenty United States dollars (US$20).

Rights you cannot sign away

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, and some give consumers rights that cannot be waived by agreement. Nothing in these terms excludes, restricts or modifies any right or remedy you have that cannot lawfully be excluded, restricted or modified — including, where they apply to you, consumer guarantees under the law of your country or state. Where a limitation in these terms is not permitted, it applies only to the extent the law allows, and the rest of these terms stays in force.

Governing law

These terms are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or to Elemora is to be brought exclusively in the state or federal courts located in Butler County, Ohio, and you and Idlery Services LLC each consent to the personal jurisdiction of those courts.

If you are a consumer resident outside the United States, this choice of law and forum does not deprive you of the protection of mandatory consumer law in your country of residence, or of the right to bring proceedings in your local courts where that right cannot be excluded.

If a court decides that any part of these terms cannot be enforced, the rest stays in force. Our not enforcing a term on one occasion is not a waiver of it.

Where Elemora is offered

Elemora is offered through the App Store in the storefronts where it is listed. If you use it elsewhere, you do so on your own initiative and you are responsible for complying with any local law that applies to you.

Not for children

Elemora is a general-audience educational app and is not directed to children under 13. If you are under the age of majority where you live, you may use Elemora only with the involvement of a parent or guardian who agrees to these terms.
